Wiluna settles key legal disputes

Wiluna Mining Corporation reports that a deed of settlement and release has been entered into between Wiluna and all of its subsidiaries (the group), AIM Mining Corporation, Milan Jerkovic, the company’s former administrators and deed administrators, the trustees of the Wiluna Creditors’ Trust (Trustees) and FTI Consulting (Australia).

The settlement deed provides for the settlement, on a without admission basis in full and final, of the various proceedings and associated disputes, with each party bearing its own costs.

The settled proceedings include:

*The proceedings in the Supreme Court of Western Australia with case number COR 158 of 2025 commenced by Jerkovic against the former administrators, the trustees and the group (COR 158 proceedings);

*The residual costs issues in the proceedings in the Supreme Court of Western Australia with case number COR 169 of 2025 commenced by the former administrators seeking directions in respect of the deed administration of the group (COR 169 proceedings);

*The residual costs issues in the proceedings in the Supreme Court of Western Australia with case number COR 175 of 2025 commenced by AIM against the former administrators, the trustees and the group (COR 175 proceedings); and

*The proceedings in the Federal Court of Australia with case number WAD 149 of 2026 commenced by AIM against Wiluna relating to Wiluna’s extraordinary general meeting held on May 15, this year.

“The board considers that the settlement is in the best interests of the company and its shareholders. It removes the distraction, cost and time associated with the proceedings. It represents the next step in the process of derisking and removing the company’s legacy issues as we advance the Wiluna gold project,” Wiluna MD Victor Rajasooriar comments.
